PFI Commercial Consultant 

We are recruiting for a PFI Commercial Consultant  to work with a leading friendly and inclusive PFI Property infrastructure organisation. The role offers  flexible hybrid working including home working and ideally the ideal candidate will be based near the Stoke area

Summary

  • Salary £80,000 + competitive pension contribs + 30 days holiday + stats, h/care discret bonus (£88,000 Package + benefits)

The PFI Handback advisor will be responsible for the commercial support to PFI projects relating to the handback obligations.

The role will involve managing multiple stakeholders, understanding contractual obligations, and reporting to the Project Co board of directors. Ensuring that Project Co's risks and liabilities are minimised and effectively managed and opportunities for enhancements are identified and delivered

Duties:


  • Manage and coordinate expiry commercial matters.
  • Manage and attend regular and ad hoc calls and meetings (in-person and remote) pertaining to contract expiry with Project Co, FM Co and other parties as required, including production of minutes and action trackers as needed.
  • Act as the main point for contact for Project Co with key project parties on matters of expiry and handback.
  • Oversee the procurement, appointment and management of Specialist Advisors and Legal Advisors to Project Co on matters relating to contractual expiry and handback (subject to the instruction of the Board of Directors).
  • Oversee the development and maintenance of a detailed expiry specific risk register to support strategic decision making by Project Co.
  • Contractual and Commercial protocols
  • Hand back works - Advise on contractual and commercial implications of releasing payments to the party undertaking the works  and support measures required (e.g.withholding notices) if payment should not be released.Financial management suppor
  • Support Project Co in relation to commercial strategies for the management, mitigation and/or resolution of any identified actual or potential post-expiry liabilities.

Qualifications/Requirements


  • Proven experience working on PFI projects at a senior level.
  • Knowledge of PFI Project Agreements and the interdependencies of the various sub-contract arrangements.
  • Experience of Project Documents and contractual obligations of SPV companies.
  • Management of PFI subcontract arrangements and their appropriate provisions.
  • Oversight of PFI payment mechanisms.
  • Good presentational and communication skills
  • Strong intellect and desire to succeed. Focused on delivery and success.
  • Strong commercial edge but with a sensitivity to client needs and requirements
  • Proven ability to work effectively with a broad range of stakeholders on a major project (including finance, design, construction and service provision).
  • To be able to act at a senior level with all stakeholders (including lawyers, financiers, investors).
  • Experience of the commercial and legal structures of PFI, an understanding of the business proposition, risk management and funding issues on major commercially complex projects.
  • Experience in co-ordinating with multi-disciplinary teams.
  • Desirable to have a broad knowledge of the key success/failure factors related to the specific sector or project. Additional relevant experience may include facilities management/lifecycle.
  • Desirable to be able to demonstrate a strong sense of corporate social responsibility, balancing the interests of stakeholders
  • University Degree of equivalent
  • The contractual and funding structure of PFI projects.
  • Hard and Soft FM maintenance regimes
  • Detailed understanding of payment mechanism mechanics
